Terms and Conditions

By choosing to practice yoga or meditation with Nikki Timney Wellbeing (Nikki Timney), both online (live and recorded) and in person, you may be exposed to risks, including accidents, injury, or damage to property. Before starting a new form of exercise like yoga, you should speak to a medical professional to ensure that it is safe for you and your body.

Yoga and meditation are not substitutes for medical attention, examination, diagnosis, or treatment. It is the partaker’s responsibility to notify Nikki Timney Wellbeing of any illness, injury, recent surgery, or pregnancy before each live yoga or meditation class. You should not perform any yoga postures to the extent of strain or pain. If at any time during online classes and in person classes, you feel discomfort or strain, gently come out of the yoga posture. You may rest at any time during the classes. It is important in yoga and meditation that you listen to your body, and respect its limits at all times.

Neither the teacher, nor the hosting facility, is liable for any injury, or damages, to person or property, resulting from the taking of online classes (live and recorded) and in person classes.

Refunds for purchases through Nikki Timney Wellbeing will not be given unless under extreme circumstances which will be determined at the business owners discretion.

Retreat Bookings

The information in the retreat brochure, these conditions, and any other written information we brought to your attention before we confirmed your booking, form the basis of your contract. Please read them carefully. By making a booking, you agree to be bound by all of them. The key terms of the agreement are:

1. Booking

(a) Your booking is not considered definite and no contract will exist until we receive payment of your non-refundable deposit. By booking a retreat with Nikki Timney Wellbeing you are accepting these terms and conditions.

(b) We do not share customer details with any third parties.

2. Payment

(a) The price is the exact amount to be received in full by us in GBP.

(b) The full payment amount is due 8 weeks or more before the first day of the retreat and can be paid by debit or credit card. If full payment is not made 8 weeks or more prior to the start date of our retreat it will be assumed that you wish to cancel your booking without refund of your original deposit. If the booking is made less than 8 weeks before departure, the full amount is due on booking.

3. Your Travel Arrangements

All travel arrangements are your responsibility and at your own cost. We shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost, unless otherwise specified.

You are responsible for ensuring that you have a valid passport and any necessary visas, as well as any necessary or required inoculations or other health requirements.

4. Travel Insurance

Your retreat with us does NOT include travel insurance and it is your responsibility to ensure you have adequate insurance cover. In accordance with normal industry practice, we will require you to have adequate travel insurance to provide accident and medical cover before your holiday departs. Such insurance should be valid from the date of booking, be valid throughout the holiday duration and financially cover any loss through cancellation, amendment, accident or health related problems. You should ensure you are covered for all activities you are planning on your trip. You should bring your own travel insurance policy with you in case of an emergency.

5. Your Health

(a) It is your responsibility to let your Hosts and Yoga Teacher know of illness, injury or recent surgery. It is recommended that you do not attend the retreat if you are pregnant. It is important to be mindful at all times of your own body’s capabilities during the retreat. If you experience any injury or discomfort during any activity during the retreat, then you must desist immediately.

(b) It is also your responsibility to consult a doctor with an understanding of yoga to check that you are sufficiently fit and healthy to undertake yoga classes and other physical activities that you may choose to do whilst on the retreat.

(c) Please advise us of any mental or physical health conditions, allergies and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on our retreats, we reserve the right to advise you to desist and in the interests of your health, or others, we may decline your stay at our retreats. All activities on the retreat are optional. By choosing to partake in the activities you are liable for the associated risks.

6. Cancellation by you

(a) You (or any member of your party) may cancel your booking at any time, providing that the cancellation is made by the person submitting the booking form and is notified to us via email. Cancellation will take effect the day such notification is received by us. If such cancellation is made more than 8 weeks before the first day of the retreat, we will retain the deposit of the retreat. If cancellation is made less than 8 weeks before the first day of the retreat, we will retain the full amount paid by you.

(b) Bookings are for the stated period of the retreat. There are no refunds for an unused portion of the retreat. If the reason for cancellation is covered under the terms of your Insurance Policy, you may be able to make a claim on your own insurance.

7. Amendments by us

By booking onto the retreat you confirm that you have read the retreat brochure and are aware of what is included in your booking. Occasionally, changes may have to be made (e.g., yoga teacher, class times or other arrangements), which we reserve the right to do at any time. If your accommodation has to be changed, we will do our utmost to provide accommodation of a similar standard. If a significant change becomes necessary, we will inform you as soon as possible before your departure. If we become unable to provide a significant proportion of your package arrangements after you have departed, we will try to offer you suitable alternative arrangements of, where possible, equivalent or higher quality than those specified.

8. Cancellation by us

We reserve the right in any circumstances to cancel a retreat. In particular our retreats require a minimum number of at least 80% of the participants to have booked by 4 weeks before the start date. If this minimum number is not reached by that date we may cancel and refund payment to you, or offer to move your booking to an alternative retreat. The cost of flights will not be refunded.

Compensation will not be payable in any cases where an amendment, change or cancellation is due to “force majeure”, being unusual or unforeseeable events or circumstances beyond our control, the consequences of which neither we nor our suppliers could avoid. These include, but are not limited to, war, threat of war, riot, civil disturbance or strife, terrorist activity (actual or threatened), industrial disputes, technical or maintenance problems with transport, machinery or equipment, power failure, natural or nuclear disaster, fire, flood, drought, adverse weather conditions, levels of water in rivers, acts of God, pandemic, closure of airports, changes of schedules or operational decisions of transport providers.

9. Guest behaviour

Guests must be respectful and must not engage in offensive, illegal or immoral acts. Should a situation of this nature arise, or should a guest become a nuisance to staff whilst on a retreat, then we reserve the right to ask a guest to leave our premises or suspend their activities if it is appropriate to do so, without any compensation.

10. Our liability to you

(a) We accept responsibility for ensuring that the retreats are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

(b) We do not accept any liability for cancellations, delays or changes caused by unavoidable and extraordinary circumstances, including but not limited to war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.

(c) We are not liable for any injuries you may incur. Yoga classes, swims, walks and other activities are undertaken at your own risk. We are not liable for any medical or psychiatric conditions, which may develop during or subsequent to the retreat. We are not liable for loss of, or damage to, your personal property.

11. Group Bookings

Where a booking is made on behalf of several individuals the booking is conditional on the person(s) paying having authorization from all the individuals named on the booking form to enter into this contract. The terms of this contract will apply to each member of the group as though they had paid for their own retreat individually and directly to us.

12. No Liability for possessions

It is your responsibility to ensure that your possessions are kept safe at all times. This includes hire cars or other hired equipment. Whilst we will endeavor to ensure the security of guests’ personal possessions, we cannot guarantee it. We cannot be held responsible for any loss or damage to personal belongings during the retreat.

13. Complaints

If you have a problem during your retreat, please inform the retreat host immediately and they will endeavor to assist you. Please note that we cannot be held responsible for the individual behavior of any group member or other guest sharing your accommodation. Any unresolved complaints must be notified to us in writing within 30 days of your return.

14. Privacy Policy

We do not share customer details with any 3rd parties. Any personal information that you provide to us will be used only for the service you requested. This information is used only for administration of the site system and in the compilation of statistics used by us to assess the use of the site. This privacy policy does not cover the links within this site linking to other sites.

Photographs will be taken on your retreat. By agreeing to these terms you are consenting to photographs being taken of you which may be used for marketing purposes.
